Typical works may include

Structural and shell works

Demolition, reconstruction and restructuring affecting structural elements, load-bearing structures, facades, glazing, roofs, waterproofing and related building envelope components.

Estimated framework value

€117.5 million excluding VAT.

Maximum framework value

€150 million excluding VAT, including indexation and reserve.

Guaranteed volume

There is no guaranteed minimum order value, workload, expenditure level or number of specific contracts. Workload will depend on the Commission's needs, priorities, building portfolio and available budget.

Framework duration

Four years, firm, with a maximum contract duration of 48 months.

Specific contract size

Specific contracts may vary from several hundred thousand euros to several tens of millions of euros excluding VAT. The contractor must be able to respond to orders of different sizes and adjust its resources according to demand.

Pricing model

Tenderers must submit the completed schedule of contractual coefficients. The principal coefficients are the general fee coefficient for the complete works, the fee coefficient for sums to be justified and the coordination fee coefficient for works performed by third parties directly contracted by the Commission.

Specific contract prices are expressed in euros and are generally lump-sum prices based on the specific contract bill of quantities and the applicable framework coefficients. Prices may be revised from the sixth month after the start of works and subsequently every six months until final acceptance, using the applicable indices defined in the framework contract.

Guarantees

For each specific contract, the Commission may require either a performance guarantee or a retention of guarantee. The applicable type and amount will be defined for the specific project, but the total amount will not exceed 10 percent of the relevant specific contract value.

Funding rate

No grant funding rate or reimbursement percentage applies. This is a paid public works contract. Contractors must price all costs, overheads, profit, resources, compliance measures and delivery risks through the contractual pricing mechanism.

Award and framework operation

Initial framework award

The framework is awarded using the lowest price criterion, subject to compliance with exclusion and selection requirements. The framework may be awarded to a maximum of seven contractors.

Reopening of competition

When a requirement arises, the contracting authorities will invite the framework contractors to submit specific offers. The specific competition will include an invitation, submission conditions, project specifications, a specific bill of quantities and a draft specific contract.

Specific contracts will be awarded using the lowest price method after applying the contractual coefficients to the prices submitted in the specific bill of quantities.

A specific contract must normally be returned signed and dated within five working days after receipt from the Commission. The delivery period begins after countersignature or on the start date specified in the specific contract.

Possible negotiated additional works

Within three years after signature of the framework contract, the contracting authority may use a negotiated procedure with the initial contractors for new works similar to those covered by the framework, subject to the applicable legal conditions and a maximum of 50 percent of the initial contract value.

Eligibility and access

Participation is open to natural and legal persons established in countries covered by the EU Treaties and to international organisations. Entities established in third countries may participate where an applicable agreement with the European Union provides access to public procurement markets.

Tenderers must identify their country of establishment and provide documents normally accepted under the law of that country. Participation is possible as a single economic operator or as a joint tendering group. Consortium participation and subcontracting are both permitted.

The same entity cannot participate in the same procedure as a member of more than one consortium, or as a single tenderer and member of another consortium. Related entities may submit separate offers only if each offer was prepared independently and autonomously.

Selection requirements

The following requirements are stated in the tender checklist and supporting documents. Equivalent evidence may be accepted for tenderers established outside Belgium where the tender documents permit it.

Legal and regulatory capacity

No separate legal and regulatory capacity criterion is specified in the checklist beyond the required evidence of establishment, authority to sign and compliance with the applicable access rules.

Contractor accreditation

The tenderer must hold Belgian contractor accreditation class 8, category D, under the Belgian rules on contractor accreditation, or provide equivalent evidence recognised for an operator established outside Belgium.

Minimum financial capacity

The tenderer must demonstrate average annual worldwide turnover of at least €18.6 million over the last three years and own funds of at least €1.8 million.

The tenderer must provide financial statements for the last three financial years showing positive annual profit before tax. Where a justified reason prevents submission of the accounts, an alternative declaration may be provided. If the three-year average result is negative, additional evidence of economic and financial capacity will be required, such as an appropriate third-party guarantee or statements from an auditor or accountant.

Relevant work references

The tenderer must provide references for completed works during the last eight years, supported by certificates of satisfactory execution. The financial reference threshold may be met through one of the following combinations.

Reference combinations

Two completed works of at least €3.465 million excluding VAT each.

Three completed works of at least €2.15 million excluding VAT each.

Four completed works of at least €1.47 million excluding VAT each.

Five completed works of at least €1.07 million excluding VAT each.

Technical and professional capacity

The tenderer must demonstrate the ability to manage and coordinate complex projects involving multiple trades, especially structural works, finishing works and special building techniques, acting as a general construction contractor.

At least two certificates of satisfactory execution are required for fully completed works. Each certificate must relate to works completed within the five years before the tender deadline, with a value of at least €1 million and a special techniques component representing between 30 percent and 75 percent of the total contract value.

Minimum professional profiles

The tenderer must demonstrate access to an appropriately qualified professional team with at least the following profiles.

Required team

One project director with a Master's degree in engineering or architecture and at least 15 years of experience.

Two principal project managers with a Master's degree in engineering or architecture and at least 10 years of experience each.

Three assistant project managers with a Master's degree in engineering or architecture and at least three years of experience each.

Two principal works managers with at least 15 years of experience each.

Three assistant works managers with at least three years of experience each.

One occupational health and safety manager with at least five years of experience.

One environmental management manager who is an accredited Brussels-Capital Region building energy performance adviser for works and energy audits, with at least five years of experience.

Quality and environmental management

The tenderer must provide ISO 9001 certification or an equivalent quality management system applicable to the subject matter of the contract. An internal quality control system equivalent to the certification may be accepted where the tender documents permit it.

The tenderer must also provide ISO 14001, EMAS or equivalent environmental management evidence applicable to the subject matter of the contract. In a consortium, the tender documents indicate that the relevant evidence may be supplied by one member.

Tender submission requirements

Mandatory submission documents include the following.

Required documents

Signed declaration on honour concerning exclusion criteria for the tenderer and, where applicable, each consortium member and proposed subcontractor.

Evidence of contractor accreditation or equivalent evidence.

Turnover and own-funds evidence.

Financial statements or permitted alternative evidence for the last three financial years.

Work reference certificates and technical capacity evidence.

Curricula vitae or equivalent evidence for the required professional profiles.

ISO 9001 or equivalent quality management evidence.

ISO 14001, EMAS or equivalent environmental management evidence.

Official evidence of the entity's establishment and country of domicile.

Details of persons authorised to sign the contract, including whether they may sign alone or jointly and whether they hold a qualified electronic signature.

Details of the person responsible for contract management, including name, role, telephone number and email address.

Completed consortium questionnaire and joint tender agreement or power of attorney where applicable.

Completed subcontracting questionnaire and commitment letter for each designated subcontractor where applicable.

Completed schedule of contractual coefficients as the financial offer.

No separate technical offer is identified in the checklist for the framework tender. The eSubmission system generates an offer report automatically, and the tenderer should not sign or upload that automatically generated report.

Consortium requirements

Joint tenders are permitted. All consortium members must provide the required exclusion declaration and, where relevant, evidence supporting economic, financial, technical and professional capacity.

The consortium agreement or power of attorney must identify the lead member, recognise the joint and several liability of all consortium members for performance of the contract and authorise the lead member to represent the consortium for submission, contract administration and, where applicable, contract signature and receipt of payments.

A tenderer should ensure that the consortium structure clearly covers the full general contractor capability, including all major building trades, project management, safety, environmental management and coordination responsibilities.

Subcontracting requirements

Subcontracting is permitted, but the main contractor remains fully responsible for performance of the framework and specific contracts. The Commission may verify the legal status, exclusion position and economic, financial, technical and professional capacity of proposed subcontractors.

For a proposed subcontractor whose individual share is at least 10 percent, the tender must include a declaration of intent or existing agreement and a declaration on honour concerning exclusion criteria.

Subcontractors may not subcontract the entire part assigned to them or retain only a coordination role. Depending on whether the specific contract is grouped under a Belgian work category or subcategory, the subcontracting chain is limited to three or two levels respectively.

The Commission may reject a subcontractor that does not satisfy the applicable exclusion or selection criteria. Approval of a subcontractor does not reduce the main contractor's responsibility towards the Commission or third parties.

Operational and technical conditions

The successful contractors must operate as general contractors covering the full range of relevant construction trades, either directly or through consortium members and subcontractors. The scope may include structural works, building envelope, roofing, waterproofing, finishes, flooring, painting, joinery, partitions, ceilings, HVAC, building management, smoke extraction, electrical systems, sanitary installations, fire detection, security systems, scaffolding and protection measures.

Most works are expected to take place in occupied buildings. Contractors must plan and execute works without disrupting Commission operations and may be required to work outside normal operating hours, including evenings, nights, weekends and public holidays, subject to prior agreement.

Normal Commission operating hours are generally 07:00 to 18:00 on working days. Access requests normally need to be submitted three working days in advance. Certain sensitive or confidential areas require a specific and detailed access request.

The contractor must provide all equipment and technical means necessary for execution. The Commission provides access, available documentation and project information but does not provide the contractor's equipment or technical resources.

Each specific project will normally require a project manager and assistant project manager. A project manager may not be responsible for more than two simultaneous sites unless the Commission agrees otherwise.

The contractor must appoint a contract representative with authority to take decisions and legally commit the contractor. A qualified substitute must be available to replace the representative when necessary.

Safety, environmental and compliance obligations

The contractor must comply with Belgian labour, safety, environmental, construction, fire safety, electrical, waste management, urban planning and accessibility rules, together with relevant European and Belgian standards and Commission security procedures.

The contractor must respect the Commission's sustainability, circularity, EMAS and green public procurement expectations. Environmental clauses form part of the tender documents and apply to works carried out under the framework.

Asbestos management is a material operational requirement. Contractors must consult the asbestos inventory before each site intervention, train relevant personnel in asbestos risks, provide competence certificates when required and immediately report suspected asbestos-containing materials.

For each specific project, the contractor may need to prepare a project-specific health and safety plan, fire and dust permits, isolation requests, site installation plans, waste management plans, execution drawings, calculations, technical documentation, test reports, certifications and detailed programmes.

The contractor is responsible for sorting, loading, transporting and recycling or disposing of construction waste and demolition materials in accordance with applicable requirements.

French language requirement

Personnel responsible for coordination and execution must have a command of French. Correspondence, reports and technical documents must be prepared in French.

Site management and acceptance

A minimum weekly coordination and progress meeting is expected for each specific project, involving the Commission, the design team, the control office, the health and safety coordinator and the contractor.

The contractor must maintain current personnel registers and project documentation at the site and make them available for inspection by the Commission and its representatives.

Before works begin, the contractor must provide documents such as execution drawings, calculations, health and safety plans, product certificates, detailed schedules, site installation plans, waste plans, test reports, certifications and material and equipment lists.

Provisional acceptance takes place after completion of the works and testing. The contractor must normally provide at least two weeks' notice and submit the provisional as-built and intervention files. Any reservations must be corrected within the deadline set by the Commission, which may not exceed two months.

Final acceptance takes place after all reservations have been resolved and no earlier than one year after provisional acceptance.

Submission process and deadlines

Submission is exclusively electronic through the EU Funding and Tenders Portal eSubmission application. Email, post or other submission methods will not be accepted.

Each tenderer and each consortium member must be registered in the Commission participant register and have a valid Participant Identification Code. An EU Login account is required to access the submission process, submit questions and manage the tender.

The official tender deadline is 1 December 2026 at 15:00 Brussels time. The public opening is scheduled for 2 December 2026 at 10:00 Brussels time. Questions should be submitted through the portal no later than 23 November 2026 at 23:59 Brussels time, although the contracting authority is not required to answer questions submitted less than six working days before the tender deadline.

The tender validity period is six months according to the procurement data. Tenderers should verify the final notice and any amendments before submission.

The metadata supplied with the opportunity contains an additional date of 1 January 2026. This conflicts with the official tender details, invitation letter and milestone data showing 1 December 2026 at 15:00 Brussels time. Applicants should treat the live Funding and Tenders Portal notice and any formally published amendment as controlling and should not rely on the conflicting January date.

Electronic submission controls

The eSubmission receipt containing the official timestamp is the evidence that the tender was submitted on time. Tenderers should submit well before the deadline and verify that the receipt has been generated.

A submitted tender may be withdrawn or replaced before the deadline. If a replacement tender is submitted, it must contain all required information and documents again. Only the latest non-withdrawn tender will be considered.

The portal generally accepts attachments below 50 MB and permits up to 200 files for procurement submissions, subject to the current system requirements for this procedure. These technical limits should be checked before finalising the tender package.

Commercial and delivery risks for applicants

The absence of a guaranteed minimum workload is a significant commercial risk. A contractor may incur substantial mobilisation and compliance costs without assurance that the estimated framework value will be fully used.

The framework creates competition at two levels. Tenderers must first compete for admission to the framework and then compete again for individual specific contracts. A successful framework appointment therefore does not guarantee the award of project work.

The lowest price award approach places strong emphasis on cost modelling, coefficient accuracy and operational productivity. Underpricing may create substantial execution risk because projects can be complex, occupied, security-sensitive and subject to extensive documentation and coordination obligations.

The contractor must be prepared to manage variable workloads, multiple concurrent sites and projects ranging from moderate interventions to large, multidisciplinary transformations.

French-language capability, Belgian regulatory knowledge, accredited personnel, quality and environmental systems, asbestos competence and institutional security procedures are likely to be practical differentiators even though the formal award criterion is price.

Recommended applicant preparation

Applicants should complete the following actions before submission.

1. Confirm eligibility for Belgian class 8, category D accreditation or prepare a complete equivalent evidence package for the country of establishment.

2. Map the required financial thresholds against audited accounts, turnover, own funds and profit before tax for the last three financial years.

3. Select reference projects that satisfy both the value combinations and the specific technical requirement for special techniques representing 30 percent to 75 percent of the project value.

4. Secure availability and documentary evidence for all required professional profiles, including qualifications, employment or commitment arrangements and experience dates calculated at the tender deadline.

5. Confirm ISO 9001 and ISO 14001, EMAS or equivalent evidence and check that the scope of each certification covers the tendered works.

6. Decide whether to tender alone or as a consortium and document all responsibilities, joint and several liability, signing powers and capacity contributions.

7. Identify critical subcontractors, obtain commitment letters and prepare exclusion, capacity and scope information for each relevant subcontractor.

8. Build a French-language delivery and reporting capability suitable for occupied Commission buildings.

9. Model the contractual coefficients carefully, including overhead, profit, site management, sums to be justified and coordination of third-party works.

10. Register or validate every organisation's PIC, create EU Login access, test eSubmission and prepare files within the current file naming, format and size limits.

11. Monitor the Funding and Tenders Portal for amendments, additional documents and questions and answers until the deadline.

Overall assessment

This is a large, strategically significant construction framework with a potential ceiling of €150 million excluding VAT and access to a substantial institutional building portfolio. It is suitable primarily for financially strong and technically mature general contractors with proven complex building services coordination, Belgian or equivalent contractor accreditation, robust safety and environmental systems and the capacity to work in occupied and security-controlled buildings.

The opportunity is not suitable for a small specialist contractor acting alone unless it can form a credible consortium or general contractor structure covering the full range of required disciplines and thresholds. The principal business uncertainties are the absence of guaranteed orders, the second-stage competition for every specific contract, the lowest price methodology and the operational burden of working across occupied Commission premises.

Official sources

The official Funding and Tenders Portal page, the tender invitation, checklist, technical specifications, environmental and social clauses, financial coefficient schedule, draft framework contract and security and guarantee annexes should be treated as the controlling documents. 1
