Post-submission stages: administrative compliance check, exclusion & selection verification, technical evaluation against minimum requirements, financial evaluation (lowest price) and award. Presumed winners will be requested to provide supporting evidence for exclusion/selection documents before signing.
Success Rates:Not published. As an open tender with limited framework contract slots (one contractor per lot) competition depends on number of valid tenders submitted. Award method is lowest price among compliant tenderers; only tenders fully meeting minimum technical and selection requirements will be ranked.

What is this opportunity about and how would you explain it? 1
This is a direct procurement by the BEREC Office to establish two framework contracts (one per lot) to secure business continuity equipment and services needed to guarantee communications and power during emergencies and interruptions of local infrastructure. Lot 1 procures satellite communication hardware (handheld voice devices, messaging/SOS devices, portable broadband terminals) plus multi-country satellite service subscriptions with defined minimum allowances and administrative capabilities. Lot 2 procures portable power solutions (power banks, portable power stations, modular expansion batteries) fit for field and contingency use. The contracts are framework agreements (single contractor per lot) for up to 48 months, with specific contracts or order forms used to call-off the actual deliveries and subscriptions. Selection is based on compliance with exclusion and selection criteria and meeting minimum technical requirements; award is by lowest price among compliant tenders. All submissions must be made electronically via the eSubmission tool on the Funding & Tenders Portal and must follow the forms and templates provided (Declaration on Honour, Financial offer template, technical specifications). Prospective tenderers must ensure eligibility (no restrictive measures), prepare documentation proving legal, financial and technical capacity, and use the provided financial models. The procurement documents (invitation, administrative and technical specifications, draft FWC, financial templates) provide complete contractual, technical and procedural details and must be followed exactly.

Who can apply
Any interested economic operator that meets the procurement rules and selection requirements may submit a tender. Eligible applicants may participate as a sole tenderer or as a joint tender submitted by a group of economic operators.
Participation is open to natural and legal persons established within the scope of the EU Treaties and to international organisations. Operators established in third countries may participate where a specific agreement with the European Union grants access to this procurement on the applicable conditions.
The World Trade Organization Agreement on Government Procurement does not apply to this procedure. Economic operators established in countries without another applicable EU procurement access basis should therefore verify their eligibility before preparing a tender.
Subcontractors and entities whose capacities are relied upon must also have access to the procurement and must comply with the applicable exclusion, restrictive measures and selection requirements.
Applicant organisation and consortium requirements
Every participating organisation or natural person must be registered in the European Commission Participant Register and must have a valid Participant Identification Code. Existing participants should reuse their existing PIC and ensure that their legal, financial and SME information is current.
A joint tender must identify a group leader and define the role and tasks of each group member. Group members assume joint and several liability for performance of the contract. The group must provide the required agreement or power of attorney.
An entity may not participate for the same lot as a sole tenderer and as a member of another group. It also may not participate in two or more groups for the same lot. Cross subcontracting between competing tenderers for the same lot is prohibited where the applicable relationship creates the conflict described in the tender specifications.
Tenders must be prepared independently and autonomously. Applicants linked through ownership or control may submit separate tenders only if each tender can demonstrate that it was prepared independently.
Exclusion and integrity requirements
Applicants, group members, identified subcontractors and relied-on entities must submit the required declaration on honour and must not be in an exclusion situation. Relevant grounds include bankruptcy or insolvency, unpaid taxes or social security contributions, grave professional misconduct, fraud, corruption, participation in a criminal organisation, money laundering, terrorist financing, trafficking in human beings, serious contractual deficiencies, irregularities, circumvention of legal obligations and obstruction of audits or investigations.
The declaration also covers persons with powers of representation, decision-making or control, beneficial owners and, where relevant, persons with unlimited liability for the organisation's debts.
Applicants must not be subject to EU restrictive measures involving asset freezes or prohibitions on making funds or economic resources available. This condition applies throughout contract performance and also extends to relevant subcontractors and relied-on entities.
Applicants must disclose conflicts of interest and confirm that the tender was prepared independently. False declarations may result in rejection, exclusion or financial penalties.
Selection and capacity requirements
The tenderer must demonstrate the legal and regulatory capacity to perform the required activities, the required economic and financial capacity, and the required technical and professional capacity. The precise thresholds and evidence requirements are set out in the administrative and technical specifications.
The contracting authority may request evidence during the procedure, including documents relating to legal existence, financial capacity, professional capacity, technical experience and the absence of exclusion grounds. Applicants should prepare these documents in advance even where they are not required at initial submission.
Where selection capacity is provided by another entity, the tender must identify the relevant reliance arrangement and include the required commitment documentation. Subcontracting arrangements must be declared where required by the procurement documents.
Contract model and commercial conditions
Each lot will result in a single framework contract with one contractor. The framework establishes the terms for future specific contracts or orders but does not oblige the BEREC Office to place any minimum order or to spend the full estimated value.
The initial framework period is 12 months and may be renewed three times, resulting in a maximum duration of 48 months, subject to the draft framework contract and the applicable conditions for renewal.
For Lot 1, the contractor must price both equipment and recurring communication services. For Lot 2, the contractor must price the equipment supplied. Prices must be submitted using the applicable financial offer template and must be stated excluding VAT.
The financial offer must include all costs up to delivery to the contracting authority's site on a delivered duty paid basis where specified by the template. Applicants should account for transport, delivery, insurance, customs and other costs that are required to be included in the offered price.
Unit prices must be provided to no more than two decimal places. The financial model provides for calculation of annual service costs, four-year service costs where applicable, supply costs and the total price for the maximum contract duration.
There is no grant funding rate, co-financing percentage or reimbursement of eligible project costs. Payment is made under the resulting procurement contract for ordered goods and services, subject to the contractual terms and available orders.
Technical and operational requirements
The detailed minimum technical requirements are contained in the technical specifications and are binding. Lot 1 applicants must demonstrate that the proposed satellite devices and communication services meet the required functionality for voice communication, broadband connectivity, messaging, positioning and emergency communication.
Lot 2 applicants must demonstrate that the proposed power banks, portable power stations and modular expansion batteries meet the required technical and operational specifications for emergency power and energy storage.
Variants that do not comply with the minimum requirements are not permitted. A tender covering only part of a lot, or made conditional on the award of another lot, is not permitted.
Contractors must comply with applicable security requirements during performance. Any costs associated with security measures, including background checks or security clearances where required, are borne by the contractor unless the contract documents provide otherwise.
Contractors must support fraud prevention and detection obligations and must pass relevant obligations to subcontractors and personnel. Environmental considerations must be addressed over the life cycle of the products and services, and contractors must observe EU principles on equality, diversity and non-discrimination.
Documents required for submission
The published procurement package includes the invitation to tender, administrative tender specifications, technical specifications, declaration on honour, financial offer template for Lot 1, financial offer template for Lot 2, and a draft framework contract for each lot.
A typical submission should include the completed administrative information, the signed declaration on honour, the completed financial offer for each selected lot, technical and professional information required by the specifications, information on group members and subcontractors where applicable, evidence of reliance on other entities where applicable, and any required authorisations or powers of attorney.
The tender must be submitted in one of the official languages of the European Union. The procurement documents are published in English, and the English version is identified as the authentic version in the invitation letter.
The declaration on honour may be signed electronically using a qualified electronic signature compliant with the eIDAS framework. Where a qualified electronic signature is not available, the declaration may be completed electronically, printed, signed by hand and dated by the authorised representative, subject to the procurement instructions.
Submission mechanics and risks
Tenders must be submitted exclusively through the electronic submission system. Submissions by email, post or other means will be disregarded. An EU Login account is required to access the submission system, ask questions and submit a tender.
The Participant Identification Code is mandatory for the tenderer and each member of a joint tender. Applicants should create or validate their PIC well before the deadline and ensure that the person submitting the tender has the necessary authority.
The eSubmission receipt containing the official timestamp is the evidence that a tender was submitted on time. Applicants should not wait until the final hours because technical problems, incomplete uploads or invalid file formats may prevent a valid submission.
The portal information indicates that attachments must generally be below 50 MB per file and that the system accepts a maximum of 200 documents per tender. Applicants should verify the current system requirements because technical requirements may change.
A tender may be withdrawn or replaced before the submission deadline. If a replacement tender is submitted, it must contain all information and documents required for a complete tender; applicants should not assume that documents from an earlier version will be carried forward.
No more than one tender per lot may be considered for a tenderer, subject to the rules on withdrawal, replacement and any permitted variants. Tender preparation costs and costs of attending the opening session are borne by the tenderer and are not reimbursed.
Evaluation and award implications
The award criterion is lowest price, provided that the tender is admissible, the tenderer is not excluded, the selection requirements are met and the proposed goods and services comply with all mandatory technical requirements.
A low price that results from omitting mandatory items, excluding required delivery costs, failing to price recurring services or proposing non-compliant equipment may lead to rejection. Applicants should therefore validate the financial model against every mandatory technical requirement before submission.
The contracting authority may request clarification or missing information where permitted, but clarification cannot substantially change the tender. The tender becomes binding on the successful tenderer for the contract period, while the contracting authority is not contractually bound until the contract is signed.
The contracting authority may cancel the procedure before signature without tenderers being entitled to compensation, provided that the cancellation is substantiated and communicated in accordance with the applicable rules.
Applicant action plan
1. Select Lot 1, Lot 2 or both lots and confirm that the organisation can provide the complete scope of each selected lot.
2. Register or validate the organisation in the Participant Register and confirm the PIC, legal data, authorised representatives and contact details.
3. Review the administrative specifications, technical specifications and draft framework contract together rather than relying only on the portal summary.
4. Map every mandatory technical requirement to a proposed product, service feature, certificate, technical document or contractual commitment.
5. Confirm procurement access, absence of restrictive measures, absence of exclusion grounds and absence of conflicts of interest for the tenderer, group members, subcontractors and relied-on entities.
6. Prepare the declaration on honour and supporting evidence, including legal, tax, social security, financial and technical documents that may be requested at short notice.
7. Complete the correct financial offer template, use prices excluding VAT, include all required delivery and service costs, and check all calculations and decimal-place requirements.
8. Submit any clarification questions before the applicable question deadline and monitor the portal for amendments, answers and replacement documents.
9. Upload all documents through eSubmission, obtain and retain the submission receipt, and allow sufficient time for any technical correction or replacement submission.
Overall assessment
This opportunity is most relevant to satellite communications providers, satellite equipment distributors, emergency communications specialists, telecommunications service providers, suppliers of portable power systems and battery storage equipment, and consortiums combining equipment supply with communication service capability.
Lot 1 is the principal commercial opportunity, representing approximately 85 percent of the total estimated value. It requires the ability to provide both satellite hardware and recurring communication services over a potential four-year framework period. Lot 2 is smaller and focused on the supply of emergency power and energy storage equipment.
The main commercial risk is that the estimated values and quantities are ceilings or indicative forecasts rather than guaranteed purchases. The main compliance risks are incomplete eSubmission files, failure to meet minimum technical specifications, failure to provide a complete price for all required items, invalid participation arrangements, restrictive measures, exclusion grounds and late submission.
The opportunity should be treated as a full-cost, compliance-driven procurement rather than a funding application. Success depends on demonstrating full technical conformity and submitting the lowest compliant price for the selected lot or lots.
