Non-profit organisations and universities may participate as consortium partners where they can demonstrate the required contractual, technical and commercial capacity.

Funding Type:This is a public tender / procurement for a services contract in the form of a framework agreement. The financial mechanism is contract procurement (no grant/loan/equity).

Consortium Requirement:The procedure allows sole tenderers and joint tenders (consortia). Joint tenders must provide the required documentation (agreement/power of representation Model A or B) and show joint and several liability. Subcontracting is permitted but identified subcontractors with an individual share above 15% must be declared and provide specific declarations.

Beneficiary Scope (Geographic Eligibility):Eligible economic operators are entities established in the EU and those falling within the rules of access to EU procurement procedures. The technical work includes on-site presence at EUIPO in Alicante (Spain) and deployment across EU IP offices (EU Member States) and in some international cooperation offices outside the EU when required. Tenderers must comply with EU procurement access rules and EU restrictive measures; PIC registration is required.

Target Sector:IT, ICT and Digital Transformation with emphasis on programme/project management, systems architecture, cloud and infrastructure architecture, data engineering, AI/ML/GenAI, application lifecycle and DevOps. The work supports the IP sector and public administration digital services.

Application Stages:One legal tender submission stage. After submission and public opening the evaluation phases include exclusion checks, selection criteria verification, technical evaluation and financial evaluation; award follows. For implementation, Action/Specific Contracts go through planning, solution definition, approval and execution phases per the EUIPO SDLC. The tender evaluation process is multi-step but proposal submission is a single-stage open call.

Success Rates:No historical success rate is published in the procurement notice. The award will select a maximum of 3 framework contractors; the selection will be competitive and based on best price-quality ratio. The success probability depends on the quality and competitiveness of the technical and financial proposals and compliance with mandatory requirements.

Co-funding Requirement:No co-funding from the tenderer is required by the procurement notice. The framework contract is a service contract where the contractor invoices the Office for delivered services. Tenderers must include all costs (personnel, burden, indirect costs) in their daily rates and financial proposal.

Templates:Key templates and structured documents are mandatory and published as Annex IV Standard Submission Form (includes the technical proposal and financial proposal instructions), Annex I (Tender specifications) and Annex II (Technical specifications) plus appendices. The final score formula is ((Price indicator x 30%) + (Quality indicator x 70%)).

How to apply (format and process)

Submission platform:eSubmission via the EU Funding & Tenders Portal is mandatory. A EU Login account and the organisation PIC are required. Tenders must be submitted electronically before the deadline. All attachments must follow eSubmission file format rules (files <50 MB for attachments; max 200 attachments per submission). Documents where a signature is required must be signed (hand signature scanned or qualified electronic signature). Do not send paper copies unless specifically requested later by the contracting authority. A submission receipt will be emailed by the eSubmission system and is the official proof of submission.

Required submission documents (high level):Mandatory administrative and technical folders must be uploaded following Annex IV standard submission form structure: Administrative Documents (undertakings, Legal Entity and Financial Identification Form, power of attorney), Subcontracting forms if applicable, Exclusion Criteria (Declaration on Honour and supporting evidence), Selection criteria evidence (insurance, turnover statements, quality and security certificates, registrations), Technical and Professional Capacity evidence (staff statements, references and confirmations), Technical Proposal (detailed response to Technical Specifications), Financial Proposal (Global Blended Rate € and daily rates per profile and location). Pricing and financial submission details

Daily rates and blended rate:Tenderers must propose one daily rate per profile and location (on-site in Alicante, off-site, third-party deployed profiles in EU Member States and Brussels-based reference rates for deployed staff). The financial proposal must include the Global Blended Rate (€) which is used for the price evaluation. Daily rates must be all-inclusive (management, social costs, travel, equipment, licenses). For deployed staff outside Brussels, EUIPO applies a correction coefficient based on Eurostat cost-of-living indexes to convert the Brussels-based rate into the duty station rate at offer time. Tenderers must not claim any additional costs during contract execution beyond the agreed rates.

Abnormally low offers:The contracting authority will check price elements below 30% of the arithmetic mean of the corresponding elements of the admitted offers; tenderers may be asked to justify and provide breakdowns. If judged abnormally low the tender may be rejected.

Security, data protection and compliance

Security and compliance:Tenderers must comply with EUIPO IT Security Standards (annexed appendices) and must ensure all staff who access EUIPO premises or systems pass security checks. Personal data processing must follow Regulation (EU) 2018/1725. For outsourced services and off-site access, follow the IT Security Standards for Outsourcing (Annex II Appendix). The Technical Specifications require ISO 27001 or equivalent for some selection criteria and the onboarding of deployed staff must follow BYOD and device-security guidance.

  1. 1On-site security: staff working at EUIPO premises must be able to pass security clearance checks. Original documents may be requested for verification.
  2. 2Off-site and BYOD: Remote devices must match the BYOD security guidance (antimalware, encrypted disks, OS versions), and remote access will require strong authentication and adherence to the Access Management procedures.

What the procurement is about

The framework will support EUIPO’s Digital Innovation Department in delivering information technology programmes and projects associated with the Office’s Strategic Plan 2030, future strategic plans, operational activities and initiatives involving other national or international bodies.

The required services are divided into two main service families:programme and project management services, and IT architecture services. Project management services include programme management, IT project management, project support, planning, scheduling, governance, risk management, dependency management and tracking of deliverables.

IT architecture services cover the design and alignment of technical solutions with business needs. The technical environment includes applications, middleware, corporate services, servers, storage, backup, infrastructure, data, cloud services, integration and artificial intelligence capabilities.

Services may be delivered on site at EUIPO premises, off site from the contractor’s locations, at third party premises, or through a combination of these arrangements. Individual assignments will be ordered through specific contracts or purchase orders and may use fixed price, quoted time and means, or time and means arrangements.

The services will be subject to framework level service level agreements and, where relevant, additional service level requirements for specific contracts. Contractors must follow EUIPO procedures, standards, security requirements, data protection requirements and continuous improvement processes.

Indicative financial structure

The estimated framework volume is distributed across the four expected years as follows. These amounts are estimates only and do not constitute a guaranteed order volume.

Contract yearEstimated volume
Year 1€8.10 million
Year 2€8.40 million
Year 3€8.70 million
Year 4€8.99 million
Total estimated ceiling€34.19 million

EUIPO is not committing to purchase the full estimated volume. Actual expenditure will depend on the specific contracts or purchase orders issued during implementation. Signing the framework agreement does not guarantee any minimum volume or any specific assignment.

Within three years of signing the framework agreement, EUIPO may procure repeated or similar services up to a maximum of 50 percent of the initial framework ceiling, subject to the applicable negotiated procedure and legal conditions. On the stated ceiling, this potential additional amount could be up to approximately €17.095 million, although it is not an assured contract value.

Who can apply

Eligible economic operators include natural or legal persons established within the scope of the EU Treaties and persons established in third countries that have a relevant special agreement with the European Union covering access to procurement procedures applicable to EUIPO.

Applicants may participate as a sole tenderer or as a joint tender submitted by a group of economic operators. Subcontracting is permitted. A tenderer may also rely on the capacities of other entities, provided that the required resources will genuinely be available and the necessary commitment evidence is supplied.

Joint tender members assume joint and several liability for fulfilment of the contract. The group must designate a leader that acts as the principal administrative, financial and operational contact. The group’s roles, tasks and internal responsibilities must be clearly described.

Subcontractors whose individual share is above 15 percent, or on whose capacity the tenderer relies for selection criteria, must be identified. Identified subcontractors must provide the required commitment and exclusion documentation. The main contractor remains fully liable to EUIPO for the complete performance of the contract.

Participation is not suitable for a company that cannot demonstrate substantial recent experience in both IT project or programme management and IT architecture, or that lacks the required certifications, insurance, turnover, staff capacity and supporting evidence.

The project management and architecture experience requirements can generally be demonstrated through the combined capacity of the entities involved, including relevant subcontractors, provided the procurement rules on reliance on third party capacity are met. References must include client details, scope, role, value, invoiced amount, dates and confirmation information. EUIPO may contact clients to verify the references.

The relevant three year experience period may be presented either as calendar years from 1 January 2023 to 31 December 2025 or as a strict 36 month period counted backwards from the submission deadline, subject to the detailed requirements in the tender specifications.

Expected personnel and technical profiles

The technical specifications identify the following principal staff profiles:IT Programme Manager, IT Project Manager, IT Project Support, Solution Architect, Infrastructure Architect, Data Architect and Artificial Intelligence Architect.

Applicants should prepare a staffing model showing the availability, qualifications, experience and allocation of personnel to each required profile. The proposed personnel must satisfy the minimum criteria in the technical specifications and must be available to deliver services throughout the framework period and individual assignments.

The contractor must have access to the software and productivity tools needed for integration with EUIPO processes, including Office 365, Microsoft Word, Excel, Visio, PowerPoint, Microsoft Project, Outlook and Teams, unless the procurement documents specify otherwise for a particular service.

Technical scope and delivery model

Project and programme management activities are intended to support strategic planning, IT investment planning, software development lifecycle processes, project governance, scheduling, risk management, interdependency management and delivery assurance.

Architecture activities are intended to provide technical solutions across application, integration, infrastructure, data, cloud, security and artificial intelligence domains. Applicants should demonstrate the ability to work in complex, integrated and evolving enterprise IT environments.

Specific assignments may require fixed deliverables, time based resources or a blended approach. Deliverables, acceptance procedures, reporting, meetings, service hours, knowledge management, transition in, transition out and training will be governed by the technical specifications and the applicable specific contract.

Contractors must comply with EUIPO information security provisions and may be subject to security assessments or clearance requirements. Security clearance processes are to be carried out at no additional cost to EUIPO.

Award methodology

The award procedure uses a weighted price quality assessment. Technical quality represents 70 percent of the final score and price represents 30 percent.

Evaluation elementMaximum score or weightingKey condition
General management of services20 technical pointsMinimum 10 points
IT project management40 technical pointsMinimum 20 points
IT architecture40 technical pointsMinimum 20 points
Overall technical evaluation100 technical pointsAt least 60 points overall and at least 50 percent in each individual criterion
Quality weighting in final score70 percentQuality indicator based on the best technical offer
Price weighting in final score30 percentPrice indicator based on the lowest compliant global blended rate
Final award100 weighted pointsPrice indicator multiplied by 30 percent plus quality indicator multiplied by 70 percent

A tender that fails a minimum technical threshold will not proceed to the final award assessment. The quality score is normalised against the highest technical score. The price score is based primarily on the global blended rate stated in the financial proposal, with the lowest compliant rate receiving the maximum price indicator.

EUIPO may investigate abnormally low offers. As an indicative trigger, an individual financial element or the global blended rate below 30 percent of the arithmetic mean of the corresponding elements of other admitted tenders may lead to a request for detailed explanation and supporting information. An offer may be rejected if it is found to be abnormally low or incompatible with applicable labour, social security, health and safety or other legal requirements.

Framework agreement structure and duration

The framework agreement will be implemented without reopening competition. Up to three contractors may be selected and ranked in descending order according to their final scores. The ranking establishes the cascade sequence for the offer of specific contracts or purchase orders.

When a requirement arises, EUIPO will normally approach the contractor first in the cascade. If that contractor cannot perform the assignment, has a professional conflict of interest, or is otherwise unavailable under the framework rules, EUIPO may approach the next ranked contractor.

The initial framework period is 24 months. It may be renewed up to two times for one year at a time, subject to a maximum overall duration of 48 months. Renewal is not an entitlement and the framework does not grant exclusive rights or guarantee any orders.

There is no tender guarantee and no bank guarantee requirement identified for this procurement. The framework agreement becomes effective only when signed by the final contracting party. EUIPO may cancel the procedure or abandon the award before signature without an obligation to compensate tenderers.

Submission requirements

Tenders must be submitted exclusively through the electronic submission system connected to the Funding and Tenders Portal. Email, post and other submission methods will be disregarded.

Each organisation participating as a sole tenderer, joint tender member or relevant entity must be registered in the European Commission Participant Register and have a valid Participant Identification Code. A joint tender must identify all members and designate its leader.

An EU Login account is required for electronic submission, access to the procurement documents, subscription to updates and submission of questions. Applicants should create or verify their EU Login and Participant Register records well before preparing the final tender.

The tender must be valid for nine months after the submission deadline. Submission implies acceptance of EUIPO’s general terms and conditions, the procurement documents and the draft framework contract, and waiver of the tenderer’s own conflicting terms and conditions.

The eSubmission receipt containing the official timestamp is the evidence of timely submission. Applicants should submit early because the relevant time is when the system receives the complete submission, not necessarily when the final submission button is selected.

The published submission form indicates that attachments should be organised in the designated folders and that signed documents may be signed by hand and scanned or signed using an accepted electronic signature. Individual files must comply with the eSubmission system limits and technical requirements.

Core documents to prepare

Applicants should use the standard submission form and follow the document order and naming conventions in the procurement documents.

The expected submission package includes the following items.

  • Signed standard submission form and tender identification information
  • Brief history and activities of the tenderer, limited to the requested length
  • Legal Entity and Financial Identification information
  • Written undertaking for a joint tender, where applicable
  • Power of attorney or evidence of authority to sign, when requested
  • Commitment letter for reliance on third party capacity, where applicable
  • Subcontracting information form
  • Commitment and declaration documents for identified subcontractors
  • Declaration on Honour covering exclusion and selection criteria
  • Professional risk insurance certificate or policy evidence
  • Turnover statement for the last three closed financial years
  • List of relevant project management and IT architecture contracts
  • Reference confirmation forms and supporting client evidence where available
  • Qualified staff statement and evidence of proposed personnel capacity
  • Quality certification evidence
  • Information security certification evidence
  • Environmental management certification evidence
  • Professional or trade register evidence for each participant
  • Technical proposal
  • Financial proposal using the prescribed format

Key applicant risks and practical considerations

  • The framework ceiling is not a guaranteed revenue commitment. Business planning should account for uncertain order volumes and cascade competition.
  • The €9 million annual turnover requirement and €1 million professional indemnity requirement may exclude smaller standalone suppliers unless they form a compliant consortium or rely appropriately on other entities.
  • The experience requirements cover both project management and architecture, with substantial annual value thresholds and specific technical subject matter requirements.
  • ISO 9001, ISO 27001 and EMAS, ISO 14001 or equivalent certifications are explicit selection requirements for the relevant tenderer or consortium member.
  • The same individual cannot be used to satisfy multiple required staff profiles, so a sufficiently broad and credible resource pool is necessary.
  • Joint tender members are jointly and severally liable, which requires clear internal governance, liability allocation and financial arrangements.
  • Changes to the composition of a joint tender or identified subcontractors after submission may require EUIPO approval and may be rejected if they alter the tender materially.
  • Professional conflicts of interest may be assessed before each specific contract and can result in the opportunity being passed to another framework contractor.
  • All technical and financial assumptions should be unconditional and fully stated in the tender. New prices or substantive new tender elements cannot normally be added after the deadline.
  • Prices must be expressed in euros and should be submitted free of VAT because EUIPO benefits from the applicable tax exemptions.
  • Performance is subject to service levels, possible penalties, audits, confidentiality obligations, security requirements and EUIPO procedures throughout the contract period.

Recommended bid preparation plan

  1. 1Confirm eligibility of the lead entity, consortium members, subcontractors and relied upon entities against EU procurement access and restrictive measure rules.
  2. 2Verify Participant Identification Codes, legal entity data, financial identification data and EU Login access for every relevant organisation.
  3. 3Map the required profiles in the technical specifications to named personnel and verify that no person is proposed for more than one profile.
  4. 4Build a reference matrix covering the required project management and architecture values, dates, client confirmations and specific technology topics.
  5. 5Collect current certificates for professional indemnity insurance, quality management, information security, environmental management and professional registration.
  6. 6Agree the consortium leader, governance model, joint liability position, work allocation and commitment letters before submission.
  7. 7Develop the technical proposal directly against the scored questions and demonstrate how the proposed delivery model will achieve at least 50 percent in every technical criterion and 60 percent overall.
  8. 8Prepare the financial proposal using the prescribed global blended rate and all required prices, ensuring that the offer is complete, consistent and commercially sustainable.
  9. 9Review the draft framework contract, service level agreement, security clauses, data protection provisions, payment terms, audit rights and performance penalty provisions.
  10. 10Submit questions through the Funding and Tenders Portal before 2 December 2026 and monitor the portal for corrections, clarifications and amended documents.
  11. 11Complete a full electronic submission rehearsal and submit with sufficient time to receive and verify the official eSubmission receipt before 10 December 2026 at 13:00 Europe/Madrid time.

Overall assessment

This is a large, strategically significant EU institutional IT services procurement suited primarily to established technology consultancies, systems integrators, professional services firms or consortiums with strong public sector or enterprise IT experience. The opportunity is commercially substantial but competitive because the framework may produce up to three ranked suppliers and does not guarantee orders.

The strongest applicants will combine demonstrable recent delivery of complex IT programmes with deep architecture capability, credible senior personnel, the required certifications, mature security and quality systems, and a technically detailed response that performs strongly against the scored criteria. A low price alone is unlikely to compensate for a weak technical proposal because quality accounts for 70 percent of the final award score.

The metadata supplied with the opportunity contains an additional date of 1 January 2026, but the official procurement record and invitation to tender identify 10 December 2026 at 13:00 Europe/Madrid time as the operative tender submission deadline. Applicants should rely on the live portal record and any subsequent official amendments rather than the inconsistent metadata date 2.

Sources and document set

The official opportunity page contains the call record, submission access, questions and answers area, and the seven published procurement documents. Applicants should review the invitation to tender, tender specifications, technical specifications and appendices, draft contract, standard submission form and service level agreement in their current versions before submission.

The principal source is EUIPO EU Funding and Tenders Portal opportunity. The official procurement authority information is also available through EUIPO public procurement.

Footnotes

  1. 1The published tender specifications state that the final score is calculated using a 70 percent quality weighting and a 30 percent price weighting, with up to three framework contracts awarded to the highest ranked compliant tenders.
  2. 2The opportunity metadata lists an additional date of 1 January 2026, but the official call details and invitation to tender state that tenders must be received by 10 December 2026 at 13:00 GMT plus 1, corresponding to Europe/Madrid time.
