Eligibility, evaluation and administrative requirements

Eligible Applicant Types:Acceptable applicants: sole legal entities or groups of economic operators (joint tenders). Eligible legal types include startups, SMEs, large enterprises, universities, research institutes, non‑profit organisations, consultancies, NGOs, international organisations and national authorities where the procurement rules permit. Subcontracting is permitted; identified subcontractors whose share exceeds 20% or who are relied upon for selection criteria must be declared in Annex 4 and provide commitment letters (Annex 5.1). Entities on whose capacities the tenderer relies must provide Annex 5.2 commitment letters. Non-EU third-country entities are excluded where the EUDA falls outside procurement agreements that allow their participation; see Section 2.2 of the Tender specifications.

Funding Type:This is a public procurement framework contract for services (service contract). The Agency will pay contractors for service orders (specific contracts) placed under the framework; the procurement is not a grant, loan or subsidy.

Consortium requirement:Single tenderers or joint tenders (consortia) are both allowed. If submitting as a group, a group leader must be appointed and an Agreement/Power of Attorney (Annex 3) must be signed by all group members. Joint tenders require joint and several liability; group composition cannot change after submission except in exceptional circumstances described in Section 2.4.1 of the tender specifications.

Beneficiary Scope (Geographic Eligibility):Participation is open to natural and legal persons within the scope of the EU Treaties. The procurement is not open to entities established in third countries that would normally participate only under specific international procurement agreements, because decentralised EU agencies are not covered by those agreements; participation is therefore limited to entities established within the EU and to entities otherwise permitted under the procurement documents and applicable rules. Tenderers must indicate country of establishment and provide evidence acceptable under national law.

Target Sector:Thematic sectors targeted: drugs policy and monitoring, public health and epidemiology, forensic chemistry/toxicology, crime and security, social research, data science, statistics and geospatial analysis, evaluation and impact assessment, digital services (dashboards and data engineering), training and knowledge exchange.

Mentioned Countries:Explicit country references in the procurement notice: Portugal (EUDA seat in Lisbon). The procedure is EU-focused with Member States and EU institutions as primary partners; case study examples and international cooperation references include Ukraine in a case study context. Tenderers should assume EU/EEA/Member State geographic context for most deliverables.

Project Stage:Expected maturity: research, development, validation, demonstration, and operational analytics leading to repeatable implementation (TRLs 5–8 equivalent in data/analytics). The framework supports rapid, targeted research and analytical tasks across stages from evidence synthesis to pilot tools and dashboards.

Funding Amount:Estimated overall procedure value / framework ceiling: €8,000,000. Individual specific contracts will be issued against the framework ceiling; the quantities in Annex 6 (Financial Tender Form) are indicative and used for financial evaluation only. The framework contract ceiling shall not be exceeded.

Application Type:Applicants must submit a full formal tender (technical and financial offers) in response to the open call on the F&T Portal (eSubmission). The call is an open single-stage procedure for the framework award. Tenders must include required annexes and declarations according to Annex 1 (List of documents to be submitted).

Nature of Support:Money (payments for services) will be provided under specific contracts issued from the framework. The Agency will pay contractors for service provision. Non-monetary services include access to EUDA networks, data (as permitted), coordination and integration with EUDA activities.

Application Stages:Single procurement submission stage (one-stage tender). Evaluation phases include administrative check, exclusion checks, selection criteria assessment (legal, financial, technical), quality scoring using four case-study responses (4 x 100 points = 400, with minimum thresholds: 50/100 per case study and minimum overall quality 260/400 = 65%), financial evaluation (via Annex 6 Price Offer workbook using 16,000 estimated workdays scenario), ranking and award. After framework award, each specific contract is subject to a further call/offer process in the cascade where the ranked contractors are invited to reply within specified time windows; that is the post-award ordering stage.

Success Rates:Not published. The framework will be awarded to the first three ranked compliant tenderers (maximum three contractors). The success probability depends on the number and quality of tenders received and the tenderer's score against quality and price criteria; historically for high-profile EU agency framework services procurements success rates are typically below 20% for single-winner procurements but vary widely. EUDA will award up to three framework contracts from this call.

Co-funding Requirement:No co-funding from the tenderer is required as a condition for participation. Tenderers must however price all items as all-inclusive daily rates and the financial offer must cover all costs including travel, accommodation and subsistence for on-site work (Lisbon) and off-site work. The tenderer must confirm that the tender is not abnormally low in accordance with Financial Regulation provisions.

Application content and templates

Tenderers must follow the strict document and template requirements. Failure to include required documents in eSubmission will lead to rejection. The main required documents and templates are listed in Annex 1 of the tender specifications and include the Declaration on Honour (Annex 2), Power of Attorney / Joint Tender Agreement (Annex 3), List of Identified Subcontractors (Annex 4), Commitment letters by identified subcontractors or entities on whose capacities is relied (Annex 5.1 / 5.2), the Financial Tender Form (Annex 6) which must not be modified, Services and Profiles required (Annex 7), case studies (Annex 8) which must be answered as part of the quality evaluation, draft framework contract (Annex 9), and Annex 10 EUDA Guidelines on the use of Artificial Intelligence by external parties (must be complied with and declared where AI is used).

  1. 1Annex 1: List of documents to be submitted with the tender (identifies which entity in a consortium must submit each document).
  2. 2Annex 2: Declaration on Honour (exclusion and selection).
  3. 3Annex 3: Agreement / Power of Attorney (joint tenders must complete and sign).
  4. 4Annex 4: List of identified subcontractors (mandatory if subcontracting above thresholds).
  5. 5Annex 5.1 / 5.2: Commitment letters by identified subcontractors / entities on whose capacities the tenderer relies.
  6. 6Annex 6: Financial Tender Form (mandatory workbook with green cells to be completed; daily rates basis: 220 working days/year, 8 hours/day; on-site & off-site daily rates).
  7. 7Annex 7: Services and profiles required (detailed technical specifications; expected staffing mix and estimated workdays).
  8. 8Annex 8: Case studies (four scenarios) — tenderers must respond; quality evaluation uses these case studies.
  9. 9Annex 9: Draft Framework Contract — read and accept provisions; includes implementation modalities (cascade list, specific contract rules, contractual clauses).
  10. 10Annex 10: Guidelines on the use of Artificial Intelligence by external parties — mandatory declaration in Annex I of those Guidelines if AI is used; EUDA approval required for substantive AI uses involving EUDA data.

The technical tender must respond to the minimum requirements in Section 1.4 and Annex 7 and must include the four case study responses (maximum lengths and formats set in the tender specifications). The financial tender must use the Annex 6 financial workbook and submit the completed workbook in eSubmission. All required signed declarations (Declaration on Honour, Power of Attorney where relevant) must be uploaded in the Party sections of eSubmission as set out in Annex 1.

Evaluation method and award

Tenders will be scored using the following high-level method:quality 70% and price 30%. Quality is assessed by responses to four case studies (each scored out of 100; total quality maximum 400) with minimum thresholds of 50/100 per case study and a minimum total quality threshold of 260/400 (65%). Financial evaluation uses the total scenario price calculated from the Annex 6 Price Offer workbook based on the evaluation scenario (estimated workdays by seniority and on-site/off-site split). The final ranking score for each tender is: (lowest price / tender price)*100*30% + (total quality score/4)*70%. The first three ranked compliant tenderers that meet minimum thresholds and are not excluded will be awarded framework contracts in cascade order.

Templates and structure (how application forms look):Use the exact Annex templates. Key form structures: Annex 6 Price Offer workbook (green mandatory cells for unit prices; calculates total scenario price automatically); Annex 2 Declaration on Honour (structured questions for exclusion and selection criteria); Annex 3 Power of Attorney (group members must use this model); Annex 4 list of identified subcontractors (table with identification, roles, intended percentage of contract); Annex 5.1 and 5.2 commitment letters (short templates); Annex 7 profiles table (profiles, seniority, education, experience, indicative daily estimated volumes) and Annex 8 case studies requiring a 2,000-word technical response per study. Do not modify the structure of the Financial Tender Form.

  1. 1Financial Tender Form (Annex 6): complete all green cells; daily rates based on 220 days/year; prices in €; on-site daily rate must include travel & subsistence to Lisbon for on-site days; off-site days invoiced at off-site daily rate.
  2. 2Technical Tender: include methodology, team composition (in line with Annex 7 minimum profile mix), quality assurance, risk mitigation, and the four case study responses (max 2,000 words each).
  3. 3Declarations and supporting evidence: Declaration on Honour (Annex 2) must be signed; proofs of financial capacity (average turnover last two years min €3,000,000 consolidated) and technical references (three similar projects each ≥€160,000 in last three years) to be provided.
  4. 4Annex 1 cross-check: follow the list-of-documents table to upload attachments in the correct eSubmission Party section and the Tender Data sections (Technical offer and Financial offer).

All tenders must observe eSubmission rules (file types, maximum 50 MB per attachment, max 200 attachments, supported browsers). PIC is mandatory. Original handwritten signatures are acceptable for some documents but qualified electronic signatures (QES) are recommended.

Executive summary

This is a public procurement opportunity, not a grant. The European Union Drugs Agency intends to establish a framework arrangement with external specialists able to provide scientific research, analytical, methodological, evaluation, data, training and knowledge exchange services relating to drugs, drug use, drug markets and their consequences. The procurement is intended to give EUDA rapid access to specialised capacity as scientific priorities and evidence needs evolve 1.

The procedure is an open procedure for one undivided lot. EUDA expects to rank and conclude framework contracts with up to three contractors in cascade order. The estimated total value is €8 million over a maximum period of 48 months, but the estimate is not a guaranteed order volume and the contracting authority is not obliged to award specific contracts.

The opportunity is particularly relevant to research organisations, specialist consultancies, universities, data science and analytics firms, public policy institutes, evaluation specialists, epidemiological and social research teams, and consortiums combining complementary expertise in drug related scientific work.

Contract structure and operating model

Framework arrangement:Multiple framework contracts in cascade, with a maximum of three contractors. The contractors will be ranked and specific contracts will normally be offered according to the cascade arrangements set out in the draft framework contract.

Specific contracts:The framework contract creates a mechanism for later specific contracts or order forms. Signature of the framework contract does not guarantee that any specific contract will be awarded to a contractor.

Lots:The procurement is not divided into lots. Tenderers must therefore demonstrate sufficient coverage of the required service categories or form an appropriate joint tender or delivery structure.

Place of performance:Performance will primarily take place at the contractor premises or remotely. Work may also be required at EUDA premises in Lisbon or at other locations for meetings, events, fieldwork or other activities.

Financial scale and conditions

The indicative value for the entire framework period is €8 million. This is a maximum framework ceiling and an estimate of anticipated purchasing, not a grant allocation, fixed budget entitlement or minimum commitment. Actual orders will depend on EUDA requirements, specific contracts and available resources.

Within three years after signature, EUDA may use a negotiated procedure to purchase repeated similar services up to a maximum of 50 percent of the initial framework ceiling. This possibility is subject to the conditions in the tender specifications and the applicable Financial Regulation.

The financial tender uses all inclusive daily rates for three seniority categories and two working locations:Tenderers must price junior or assistant, intermediate or mid senior, and senior or expert personnel for both on site and off site workdays. The financial form identifies indicative four year quantities of 1,000 on site and 3,000 off site junior or assistant days, 1,500 on site and 5,500 off site intermediate or mid senior days, and 1,000 on site and 4,000 off site senior or expert days. These quantities are for evaluation only and do not create a right to receive orders.

Rate requirements:Rates must be positive, stated with no more than two decimal places and calculated on the basis of 220 working days per year and 8 working hours per day. Rates must include personnel remuneration, employer contributions, management and administration, profit, and all other direct and indirect costs. On site rates must include travel, accommodation and subsistence for work at EUDA premises in Lisbon.

Special travel costs:Where EUDA specifically requests work at a location other than Lisbon, related travel, accommodation and subsistence may be reimbursed under the framework contract, subject to prior written approval. Such workdays are invoiced at the off site daily rate.

Taxes:Prices must be quoted free of duties, taxes and other charges, including VAT. Any applicable VAT rate is indicated for information only because EU institutions are generally exempt under the applicable privileges and immunities rules.

Evaluation and award

The award method is best price quality ratio. The available procurement data assigns 70 percent to quality and 30 percent to price. The detailed subcriteria, scoring method and minimum technical requirements must be taken from the final tender specifications and their annexes.

Financial tenders are compared using the total scenario price generated from the mandatory unit prices in the financial tender form. Missing prices, non positive prices, changes to the structure of the form or failure to sign as required may lead to rejection.

Eligibility and participation

Participation is open to natural or legal persons within the scope of the EU Treaties and to international organisations, subject to the access rules in the tender specifications. Because EUDA is a decentralised EU agency, the tender documents state that economic operators established in third countries are not eligible under this procurement, including countries that otherwise have relevant EU or WTO procurement arrangements.

Eligible operators may tender as a sole economic operator or as a group of economic operators. Joint tender members assume joint and several liability, must appoint a group leader and must complete the required agreement or power of attorney.

Subcontracting is permitted. Tenderers may also rely on the capacity of other entities to satisfy selection criteria, provided the relevant commitments and evidence are submitted. The tender documents contain restrictions on multiple participation, independent tender preparation, cross subcontracting and the use of subcontracting to circumvent access rules.

All involved entities and subcontractors must comply with applicable EU restrictive measures. Entities subject to relevant sanctions, asset freezes or prohibitions on making funds or economic resources available cannot participate in the performance of the contract.

Participant registration and tenderer requirements

  • Each tenderer and each member of a joint tender must be registered in the European Commission Participant Register and have a valid nine digit Participant Identification Code.
  • The tenderer must identify its country of establishment and provide evidence normally accepted under the law of that country.
  • The tenderer must complete the required declaration on honour and provide evidence of legal, regulatory, economic, financial, technical and professional capacity as required by the tender specifications.
  • Identified subcontractors and entities whose capacities are relied upon must be disclosed using the applicable forms and commitment letters.
  • Tenderers must demonstrate that the proposed team can cover the required profiles, seniority levels and scientific service areas.
  • Tenderers must comply with research ethics, human rights, data protection, confidentiality, research integrity and applicable national and EU legal requirements.
  • Any use of artificial intelligence must comply with EUDA requirements concerning transparency, research integrity, conflicts of interest, confidentiality, personal data and responsible use.

Submission requirements

The tender must be submitted exclusively through the electronic submission address in the Funding and Tenders Portal. Submissions by email, post or other channels will be disregarded. An EU Login account is required for access to eSubmission and related portal functions.

The main published documents include the invitation letter, tender specifications, list of documents to be submitted, declaration on honour, agreement and power of attorney, list of identified subcontractors, subcontractor commitment letter, commitment letter for entities whose capacities are relied upon, financial tender form, services and profiles required, EUDA case studies, draft framework contract and guidelines on the use of artificial intelligence by external parties.

The financial tender form must be completed using the official structure. All mandatory green cells must be completed, the form must be dated and signed, and the legal representative must sign each page. Tenderers must not modify the structure of the form.

Only one tender may be considered per tenderer, subject to the rules on withdrawal, replacement and variants. Variants are not allowed. Tenderers bear their own preparation and submission costs.

Key risks and points requiring careful review

  • No guaranteed revenue. The €8 million figure is a ceiling and indicative estimate, and order volumes may vary substantially or be zero for a particular contractor.
  • Cascade allocation may limit access to specific contracts for lower ranked framework contractors, depending on the detailed cascade rules and exceptions in the draft contract.
  • The single lot structure requires broad technical coverage or a credible consortium and subcontracting model.
  • The quality weighting of 70 percent means that a low price alone is unlikely to compensate for weak methodology, staffing, relevant experience or delivery arrangements.
  • All inclusive rates must absorb substantial costs, including management, employer charges, profit and Lisbon on site travel expenses.
  • EUDA may require rapid mobilisation, multidisciplinary teams, reproducible outputs, data security and the ability to work across several scientific domains.
  • Research ethics, data protection, confidentiality, human rights and scientific integrity obligations will apply throughout delivery.
  • Artificial intelligence use is specifically addressed in the procurement documents and must be managed in accordance with EUDA guidance.
  • The contracting authority may cancel the procedure before signature without compensation to tenderers.
  • Outstanding debts owed to the EU or certain EU bodies may be offset against payments due under the contract.
  • Security, background checking and related compliance costs may be borne by the contractor.

Recommended bid strategy

  1. 1Build a multidisciplinary team covering evidence synthesis, quantitative and qualitative methods, data integration, strategic analysis, evaluation and drug related subject matter expertise.
  2. 2Use a consortium or clearly structured subcontracting model where one organisation cannot credibly cover all required profiles and service categories.
  3. 3Prepare a concise delivery model showing how experts can be mobilised quickly for specific contracts, including availability, quality assurance, project management and replacement arrangements.
  4. 4Provide strong examples of comparable work involving drug use, drug markets, public health, social policy, epidemiology, evaluation or other closely relevant evidence domains.
  5. 5Demonstrate reproducibility through documented methods, version controlled code, data management, validation, sensitivity analysis and transparent reporting.
  6. 6Explain how personal data, confidential information, research ethics, conflicts of interest and artificial intelligence use will be governed.
  7. 7Price all mandatory categories carefully and validate the financial form calculations before submission.
  8. 8Register or update the organisation and SME information in the Participant Register early, obtain the PIC and verify the authority of the legal representative.
  9. 9Submit questions through the portal before the question deadline and monitor the portal for amendments, clarifications and revised documents.
  10. 10Complete a technical compliance matrix against every requirement in the tender specifications, annexes and draft framework contract.

Overall assessment

This is a strategically relevant but demanding procurement for organisations with demonstrated scientific delivery capacity rather than a conventional project funding opportunity. Its strongest fit is for established research and consultancy providers that can combine rigorous methods, drug related subject knowledge, multidisciplinary staffing, rapid mobilisation and high quality communication outputs.

The commercial opportunity is potentially substantial because the framework can generate multiple specific contracts over four years. However, the absence of a minimum commitment, the cascade structure, the single lot, the high quality weighting and the extensive compliance requirements mean that applicants should pursue the tender only where they can present a credible end to end service model and a competitively priced, fully compliant financial offer.

Source and document basis

This report is based on the official EU Funding and Tenders Portal opportunity record and the published invitation letter, tender specifications, financial tender form and related annex metadata 1. Applicants should treat the final portal documents, subsequent amendments and the draft framework contract as legally controlling.
