Eligibility and legal basis

Legal basis:Regulation (EU) No 2021/947 establishing the Neighbourhood, Development and International Cooperation Instrument Global Europe (NDICI). Participation is open to natural persons who are nationals of, and legal persons effectively established in, a Member State of the European Union or in an eligible country or territory as defined under Article 28 of Regulation (EU) No 2021/947. All candidates (individuals or consortia) must respect nationality and eligibility rules. Candidates listed in EU restrictive measures at the award decision moment cannot be awarded the contract.

Detailed answers to categorisation and extraction questions

Below are structured and detailed extractions and interpretations of the opportunity characteristics based on the published contract notice and the Additional Information document.

Eligible Applicant Types:Eligible applicants: legal persons (companies, consultancies, NGOs, research institutions, universities), natural persons (where nationals of eligible countries), public bodies, and consortia (permanent or ad-hoc). Participation is open to entities effectively established in EU Member States or in eligible third countries as defined by NDICI Article 28. Consortia members must each meet eligibility and nationality rules, and all partners are jointly and severally liable. Subcontracting is allowed, but consortium composition at short-list stage must be respected and any change requires prior approval.

Funding Type:Primary financial mechanism: procurement / service contract (fee-based). This is not a grant; it is a paid contract procured by the EU under NDICI for external action services.

Consortium Requirement:Consortium permitted but not mandatory. Candidates may apply individually or as a consortium (permanent or ad-hoc). If applying as a consortium, selection criteria generally apply to the consortium as a whole, and each consortium member must meet certain criteria (for example the current ratio requirement must be fulfilled by each member). Between 4 and 8 candidates will be short-listed (minimum 4, maximum 8) to submit full tenders in stage two.

Beneficiary Scope (Geographic Eligibility):Geographic eligibility: Entities effectively established in EU Member States or in NDICI-eligible countries/territories as per Article 28 of Regulation (EU) No 2021/947. The contract will be performed in Bolivia and is part of the America and the Caribbean regional programme. Candidates included in EU restrictive measures cannot be awarded the contract.

Target Sector:Sectors targeted include: policy and business advisory services supporting sustainable investment and Global Gateway priorities; value chain systems; connectivity and infrastructure; energy transition and renewable energy; digitalisation; civil society and gender-related actions; economic diplomacy and stakeholder engagement; strategic communication and visibility. Main CPV: 79410000 Business and management consultancy services.

Mentioned Countries:Explicitly mentioned country: Bolivia. Programme region: America and the Caribbean. Geographic eligibility includes EU Member States and eligible third countries under NDICI Article 28 (not exhaustively listed in the notice).

Project Stage:Project maturity expected: operational/service delivery stage (implementation and delivery of technical assistance, structuring of investment opportunities, policy dialogue, communications). The contract supports identification, structuring, promotion and implementation support rather than early-stage R&D; expected tasks are diagnosis, design, advisory and facilitation.

Funding Amount:Estimated total value: €2 000 000 (excluding VAT). The contract is described as fee-based and is likely to be awarded as a single lot (LOT-0001) with the possibility to entrust follow-up similar services up to 50% of the initial contract by negotiated procedure without prior publication (option clause described).

Application Type:Submission method: restricted procedure (two-stage). Stage 1: open call for requests to participate (short-listing). Stage 2: shortlisted candidates (4 to 8) invited to submit full tenders. Submissions must be made electronically through the EU Funding & Tenders Portal eSubmission system. Deadlines and documents are provided in the procurement documents on the portal. Requests to participate must be submitted via F&T Portal; other submission methods are not accepted.

Nature of Support:Beneficiaries (contractors) will receive monetary compensation under a service contract (fee-based payments). The contracting authority will pay for delivered services; in addition beneficiaries will provide non-financial services (technical expertise, legal and financial advisory, communications).

Application Stages:Number of stages: Two-stage restricted procedure. Stage 1: submission of a request to participate (short-listing by selection criteria). Stage 2: invitation to submit detailed tenders for the short-listed candidates, followed by evaluation and contract award. Practical flow: 1) Request to participate, 2) Short-listing (4–8 invited), 3) Tender submission by invited candidates, 4) Evaluation, 5) Award and contract signature.

Success Rates:Indicative success rates depend on the number of applicants. Short-listing will invite between 4 and 8 candidates; therefore, if N candidates submit eligible requests, the probability of reaching stage 2 equals (min(8,N)/N). Final award rate for tenderers: 1 awarded contract per lot. With full competition and many applicants, typical success rates for EU restricted tenders can be low (single-digit to low double-digit percent at short-listing and below 50% at final award among invited bidders). No specific historical success rate is published in the notice.

Co-funding Requirement:Co-funding is not described as required in the procurement documents; this is a paid service contract financed by NDICI funds. Candidates must satisfy financial and economic selection criteria (turnover, current ratio) but there is no explicit requirement for co-financing by the contractor.

Selection and Award Criteria (high level):Selection (short-listing) is based on economic and financial capacity, professional capacity and technical capacity using specific quantitative thresholds. Award will be made on the best price-quality ratio (BPQR) with weights published in the procurement documents.

  1. 1Economic and financial capacity: average annual turnover over last 3 closed financial years must be at least €1,300,000. Current ratio (current assets/current liabilities) in the last closed year must be at least 1. For consortia, the current ratio must be fulfilled by each member.
  2. 2Professional capacity: during the current year and the previous two years the candidate must have on average at least 10 personnel directly employed or legally contracted in specialist areas related to the contract (sustainable investment, energy transition, communication and visibility, digitalization). Candidates must declare absence of professional conflicting interests.
  3. 3Technical capacity: the candidate must have completed at least 3 service contracts during the last 3 years, each with a value not less than €800,000, in areas related to this contract (Global Gateway related projects: sustainable investment, energy transition, communication and visibility, digitalization). Documentary evidence required.

The notice explicitly prescribes the use of the Request to Participate form (b3) and the Declaration on Honour on Exclusion and Selection criteria (a14a). Only one request to participate or tender per natural/legal person is allowed (including as consortium leader or partner). If more than one request is submitted by the same entity, all requests involving that entity will be excluded.

Language:all written communications for the tender procedure and contract must be in Spanish (this is explicitly stated in the Additional Information document). However, the TED notice includes 'Languages in which tenders or requests to participate may be submitted: English'. Candidates must check the procurement documents for final language rules; the Additional Information specifies Spanish for all written communications during the procedure and contracting stage. Be prepared to provide Spanish-language documentation and translations if necessary.

Candidates should consult the eSubmission System Requirements and Quick Guides on the Funding & Tenders Portal.

How evaluation proceeds and award

Short-listing:on the basis of requests to participate, the contracting authority will invite between 4 and 8 candidates to submit full tenders. If fewer than 4 eligible candidates satisfy selection criteria, the authority may invite those who do meet them. If more than 8 eligible candidates meet criteria, a re-examination and ranking using comparative criteria will reduce the list to the best 8 (priority given to number of qualifying contracts and then cumulative value).

Award:evaluation of invited tenders will be based on best price-quality ratio (BPQR). Exact award weighting and sub-criteria are provided in the procurement documents; candidates must consult those documents for detailed scoring and weighting.
