They must have proficiency in French and English, with one language at minimum C1 level and the other at minimum B2 level according to the Common European Framework of Reference for Languages. Exclusion Criteria

Applicants must comply with extensive exclusion criteria established in Articles 138-143 of EU Financial Regulation 2024/2509. These include bankruptcy or insolvency proceedings, failure to pay taxes or social contributions, serious professional misconduct, fraud, corruption, criminal convictions, serious breach of contractual obligations, irregular conduct, tax evasion, obstruction of investigations, and conflicts of interest. All applicants must provide a statutory declaration on exclusion criteria (Annex II). The European Parliament may request supporting documentation within 10 calendar days of submission deadline. Restrictive Measures Compliance

All applicants must guarantee that subcontractors, suppliers, and entities whose capacities are used do not fall under restrictive measures adopted under EU or EURATOM treaties. Specifically, applicants must comply with EU Regulation 833/2014 concerning restrictive measures regarding Russian actions destabilizing Ukraine. Offers from Russian nationals, Russian-established entities, or entities more than 50% owned by Russian entities are prohibited unless authorized exceptions apply. All applicants must provide a statutory declaration (Annex X) confirming compliance, dated and signed, with supporting documentation if exceptions are claimed.

Evaluation and Award Criteria

The contract will be awarded to the economically most advantageous offer based on best price-quality ratio. Evaluation uses a two-stage process combining quality assessment and financial evaluation.

Quality Evaluation (80% weighting):Mandatory oral test (interview) of approximately one hour conducted in French and English. For legal entities, the psychologist who will perform services must participate. All applicants receive identical lot-specific questions assessing psychological methodology, didactic approach, and practical implementation. Evaluation covers capacity for psychological diagnosis, collaboration with medical services, emergency situation qualification and intervention techniques, and assessment and intervention proposals in occupational and organizational psychology. Minimum score required: 48 points out of 80 to proceed to financial evaluation. Applicants will be notified in writing at least 5 days before interview date, time, and location.

Financial Evaluation (20% weighting):Based on hourly rate submitted in price schedule (Annex VIII A for Lot 1, Annex VIII B for Lot 2). Calculation: (Lowest price / Offer price) x 20 points. Final score combines quality and financial points for maximum 100 points total.

Pricing and Financial Terms

Prices must be submitted as hourly rates in euros, all-inclusive, excluding VAT and equivalent taxes. Prices are firm and non-revisable during the first contract year. From the second year onwards, prices may be revised annually on the contract anniversary based on the Harmonized Index of Consumer Prices (HICP) for the euro zone using the formula: Pr = Pi x Ir/Io, where Pr is revised price, Pi is original price, Ir is index three months before renewal, and Io is index three months before original contract entry. Either party may request revision by registered letter sent at least 3 months before anniversary. The estimated total contract value is not disclosed in the tender documents.

Payment Terms:Payment is made after contractor has properly executed all services in the purchase order. The European Parliament has 30 calendar days to pay from invoice registration date. Invoices must be submitted electronically via PEPPOL platform, Funding & Tenders Portal, or by email with advanced electronic signature. Exceptions for paper invoices apply only to contractors outside the EU, contracts with maximum 5 invoices annually, or platform dysfunction. Late payment incurs interest at the ECB main refinancing rate plus 8 percentage points, calculated from the day after payment deadline through payment date. Interest below €200 is paid only upon request within two months of payment receipt.

Submission Requirements and Process

All offers must be submitted exclusively through the eSubmission electronic application available on the EU Funding & Tenders Portal. Offers submitted by other means (email, post) will not be considered. Applicants must register in the European Commission Participant Register to obtain a Participant Identification Code (PIC), a unique 9-digit identifier required for submission. Existing registered participants reuse their existing PIC.

Required Documentation:Applicants must submit with their offer: statutory declaration on exclusion criteria (Annex II), statutory declaration on restrictive measures (Annex X), financial signatory information (Annex III), grouping information if applicable (Annex IV), subcontracting declaration if applicable (Annex V), financial information sheet (Annex VI), applicant identification sheet (Annex IX), price schedule (Annex VIII A or VIII B), copies of diplomas, detailed curriculum vitae, professional liability insurance contracts, and any other documents specified in the tender documents. Annex 0 provides a checklist of all required documents.

Submission Conditions:Only one offer per lot per applicant is permitted. If multiple offers are submitted for the same lot without withdrawal, only the last submitted offer is considered. Applicants cannot reference previous submissions to complete or correct the latest offer. Applicants may withdraw or replace offers before the deadline. All submission costs are borne by applicants and are non-reimbursable. Submission receipt confirmation from eSubmission, including official timestamp, constitutes proof of timely submission. No submissions are accepted after the deadline.

Execution Conditions and Obligations

Contractors must execute services in compliance with professional ethics and deontology. They must not treat patients already in their private practice unless those patients were clients before contract signature. Contractors must execute services personally unless subcontracting is declared in the offer. Contractors must agree on schedules and practical arrangements with the medical cabinet and respect agreed hours, accepting necessary modifications as required. Contractors must immediately report any incidents or difficulties to the European Parliament.

Service Continuity Requirements:Annual leave must be indicated to the medical cabinet at least 3 weeks in advance. Medical absences must be reported immediately. For absences exceeding 20 working days (excluding annual leave), contractors must propose a qualified substitute within 15 working days meeting the same criteria as the contractor, with minimum 5 years experience in the relevant field. The European Parliament may refuse unsuitable substitutes. Non-compliance with substitute obligations may result in contract termination before expiration.

Annual Activity Report:Contractors must submit an annual activity report at year-end and contract conclusion to the medical cabinet unit head. The report must analyze strengths and improvement areas regarding Parliament's occupational health and psychosocial prevention objectives without compromising patient confidentiality. Reports must include service execution summary by type and mode, problems or anomalies identified, improvement suggestions, monthly hours summary by activity type, and other relevant information. The European Parliament has 20 working days to approve with or without observations, or reject. Silence constitutes tacit acceptance. The Parliament may suspend approval to request additional information, with contractors having 10 calendar days to respond. Report writing is not performed on-site and costs are included in the hourly rate with no additional payment permitted.

Technical and Compliance Obligations

Contractors must comply with all applicable legislation and regulations in their country of establishment regarding taxation, social security, labor law, and accident and occupational disease prevention. They must demonstrate compliance with authorization requirements for psychological practice. Failure to obtain or renew necessary permits results in automatic contract termination without notice. Contractors must comply with strict European Parliament security procedures and provide all documents required by the security service for staff access to medical cabinet facilities, including identity document copies. Contractors are responsible for all damage caused by themselves, their staff, or subcontractors to persons or Parliament property. Contractors must hold all necessary insurance covering their staff against accidents and professional liability risks.

Lot-Specific Execution Arrangements

Lot 1 (Brussels) uses a multiple supplier mechanism under EU Financial Regulation point 34. Two independent contracts with different contractors will be awarded, each covering identical services. Services are allocated by the European Parliament based on operational needs, contractor availability, beneficiary continuity, and declared expertise. The 50/50 volume split (1350 hours each) is estimated and not contractually binding. Lot 2 (Luxembourg) uses a cascade system. Maximum three contracts are awarded to the top three ranked applicants in descending order. When issuing purchase orders, the Parliament addresses the first-ranked contractor; if unavailable, the second; then the third. Contractors may only decline orders for reasons specified in the framework agreement. Ranking remains fixed unless terminations occur.

Data Protection and Confidentiality

Personal data processing complies with EU Regulation 2018/1725 on data protection. The European Parliament Directorate-General for Personnel, Directorate for Social Services and Human Resources Support, Brussels Medical Cabinet is the data controller. Data is processed solely for tender evaluation purposes. Applicants may exercise rights under Regulation 2018/1725 by contacting pers-tenders@europarl.europa.eu.
